Agreement to Terms

By accessing and using the services provided by NexAir Solutions ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Services

NexAir Solutions provides heating, ventilation, and air conditioning (HVAC) services including but not limited to:

  • HVAC system installation and replacement
  • System repair and maintenance
  • Energy efficiency assessments
  • Emergency repair services
  • Preventive maintenance programs

Service Agreements

Estimates and Quotes

All estimates and quotes provided are valid for 30 days from the date of issuance. Final pricing may vary based on actual work performed and unforeseen circumstances.

Service Scheduling

We will make reasonable efforts to schedule services at the agreed-upon times. However, service times are estimates and may vary due to unforeseen circumstances.

Customer Responsibilities

Customers are responsible for:

  • Providing clear access to work areas
  • Ensuring pets are secured during service visits
  • Backing up important data and valuables in work areas
  • Being present during service visits for major work

Payment Terms

Payment Methods

We accept cash, check, credit card, and major debit cards. Payment is due upon completion of services unless other arrangements have been made.

Late Payments

Payments not received within 30 days of the invoice date may be subject to a late fee of 1.5% per month.

Disputes

Any billing disputes must be brought to our attention within 30 days of the invoice date. We will work with you to resolve any legitimate concerns.

Warranties

Parts and Labor

We provide warranties on parts and labor as specified in your service agreement. Warranties typically range from 90 days to 10 years depending on the service performed.

Manufacturer Warranties

Equipment manufacturer warranties are passed through to the customer and are not covered by our warranties.

Warranty Exclusions

Warranties do not cover damage caused by:

  • Normal wear and tear
  • Misuse or abuse of equipment
  • Acts of nature or external damage
  • Unauthorized repairs or modifications

Emergency Services

Emergency service calls may incur additional fees. We prioritize emergency services but cannot guarantee immediate response times due to factors beyond our control.

Limitation of Liability

NexAir Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability shall not exceed the amount paid for the specific service in question.

Cancellation Policy

Scheduled services may be canceled up to 24 hours in advance without penalty. Cancellations made within 24 hours of the scheduled time may incur a cancellation fee.

Website Usage

Our website is provided "as is" without warranties of any kind. We reserve the right to modify or discontinue the website at any time without notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the modified terms.
